Affordable rent act

The government wants to use the law Affordable rent act to make rents affordable and ensure that the rents are appropriate for the quality of the homes.

The new law consists of a number of components:

  • The initial rental prices of homes in the mid-rental segment will be restricted on the basis of the points system of the housing valuation system. This will create a new regulated mid-rental segment of homes with rents between 144 points and 186 points. Below this are homes in the social rental segment, while above this are homes classified as the liberalised rental segment;
  • The housing valuation system will be modernised to the effect that, for example, the energy efficiency of a home, the outdoor space and more modern amenities are valued more effectively. A new-build surcharge of 10% will also apply. This surcharge will apply for 20 years after the date a tenant moves in for mid-rental homes with a start date for construction before 1 January 2028;
  • The annual rent increase in the mid-rental segment will be capped at collective wage increase + 1%. This agreement applies to lettings from 1 July 2024. With regard to existing leases with a contract date before 1 July, the Maximum Rent Increase for Liberalised Rental Contracts Act will apply until 1 May 2029. For those properties, the maximum rent increase for the next five years will be capped at the lower of inflation +1% or collective wage increase +1%.
  • Local councils can set allocation rules for regulated mid-rental segment homes via a housing permit, to ensure that these homes are allocated to middle-income households. Middle-income households are single-person households with an income of € 47,699 to € 62,191 and multi-person households with an income of € 52,671 to € 82,921 (price level 2024).

Housing valuation system

Effective as of July 1st, 2024, with the enactment of the Affordable Rent Act, a number of changes to the housing valuation system will take place. Given the short amount of time between the approval of the law and its implementation, Vesteda has not yet been able to complete all administrative and system adjustments. Vesteda is currently working on the adjustment of the housing valuation reports. Therefore, the displayed number of points shown for the home you are renting is not yet final and may change once the point report is definitively established. As soon as the final score report is available, you will be able to view it on your rental portal My Vesteda, of which we will notify you. Should there be a deviation in the number of points, it cannot be to the disadvantage of the tenant.

I signed a rental contract on or after 1 July 2024

If you sign a new rental contract on or after 1 July 2024, then the Affordable Rent Act will apply to you. This new law recognises three categories:

  • Social rent: these are homes with a quality of 143 points or less. This sector existed before the new law came into effect;
  • Mid-rental: this includes homes with a quality of 144 to 186 points according to the housing valuation system. From now on, how high the rent of these homes can be depends on the quality of the home;
  • Liberalised sector: homes with a quality of 187 points or more are classified as liberalised sector. No maximum rent has been set for these homes.
I signed a rental contract before 1 July 2024

If you signed a rental contract before 1 July 2024, broadly speaking nothing will change. However, your rent could be reduced in certain cases.

You may be entitled to a lower rent if your property is classified as social rental sector. This is determined by the number of points your home has been assigned.

My home has 143 points or less (social rent)

Does your home have 143 points or less? Then it is a social rental home. For many social rental properties, the rental price matches the property’s number of points. However, it may be that you pay a rent that does not match the number of points your home has been assigned. In that case, you will be entitled to a lower rent. Sometimes this happens immediately, and sometimes after a year. This depends on your rent at the start of your rental contract.

- At the start of my rental contract, my rent was lower than the liberalisation threshold applicable at the time:

You are immediately entitled to a rent corresponding to the number of points your home has been assigned.

- At the start of my rental contract, my rent was higher than the liberalisation threshold applicable at the time:

On 1 July 2025 (one year after the law comes into effect), you will be entitled to a rent corresponding to the number of points your home has been assigned.

My home has 144 to 186 points (mid-rental)

If your home has 144 to 186 points, your home is in the mid-rental segment. In principle, nothing will change for you in that case. The landlord is only obliged to comply with the maximum rental price that corresponds to the number of points a home has been assigned when entering into a new rental contract.

My home has 187 points or more

If your home has 187 points or more, then your home is in the liberalised sector. Nothing changes in that case. There is no maximum rental price for your home.

Will my home be surveyed?

Most homes are surveyed remotely. In a few cases, this does actually require a look inside the home. If this proves necessary in your case, an appointment will be made with you and you will be informed of this in good time.

Where can I find my score report?

We are currently busy adapting our systems to the new law. As a result, the "new" point reports are unfortunately not yet available and visible. We expect these to be published in the last quarter of 2024 in your My Vesteda account. In the meantime, however, you can fill in your own points report via the Rent Check: Rent Tribunal’s Rent Check.

Where do I find the property or WOZ value of my rental home?

Where can I find the survey report for my home’s energy label?

You can download the underlying report of the label (in Dutch) at https://mijn.overheid.nl/.

Do I need Vesteda’s permission to have my points assessed?

You do not need our permission to have your points calculated. You can calculate your points yourself via the Rent Tribunal’s Rent Check. You will then also immediately see the rent that matches the number of points your home has been assigned.

I cannot figure out what exactly the Affordable Rent Act means for me. Can I contact Vesteda with any questions I might have?

What does the new-build surcharge entail?

The new-build surcharge will apply to homes with a start date for construction before 1 January 2028. Homes eligible for the new-build surcharge can be assigned a 10% surcharge on the maximum rent for a period of 20 years. In 2027, it will be assessed whether it will also be necessary to apply the new-build surcharge to homes with a start date for construction after 1 January 2028.

Where can I find the energy label of my rental home?

You can look up the energy label of your home (in Dutch) at https://www.energielabel.nl/woningen/zoek-je-energielabel/. If you do the rent check via the Rent Tribunal, your energy label will be displayed automatically once you have entered your address details.

How many points does my home have?

The number of points assigned to your home is determined by, for example, the surface area, the energy label and the property value (WOZ value). This number determines the maximum rent.

You can calculate your points yourself using the Rent Tribunal's check (In Dutch) . This will immediately show you the rent that matches the number of points your home has been assigned.
